Petkim invites eligible bidders to submit their sealed bids for supply of Distributed Control System (DCS) for PETKİM Acrylonitrile (ACN) Plant on Lump-sum turn-key basis including engineering services, procurement services, supply of equipment and material, erection (installation), commissioning, start-up and supervision services. Bidding procedure shall be executed at two stages. Priced bid can be submitted at second stage, if technical part's evaluation is responsive.

The Bidders shall present following documents for bidding.
 
•  A legal address statement for the purpose of notification.
 
•  Copies of the original documents defining legal status. Place of registration and principal place of business of the BIDDER.
 
•  A registration certificate provided from the competent Chamber of Commerce/Industry to where the BIDDER is registered in accordance with the legislations of his country, in the year when the tender is made and proving that he is registered there to
 
•  The documents required for taking PETKİM Tender Document :
 
•  Location of engineering and procurement center(s) where design and engineering Works performed and purchasing activities carried out. The address of Technical Service Office where the repair, trouble shooting and maintenance job to be performed for 24 hours when needed.
•  Telephone and telefax number and exact address of BIDDERS references in last ten (10) years proving that the BIDDER has performed (completed) Distributed Control System for Petrochemical and/or Acrylonitrile processes (plants) on turn-key basis including engineering, procurement, supply of equipment and material, erection and installation, commissioning, start-up and supervision.
•  If any person or domestic company applies to take Petkim tender document as a representative of a foreign company, a letter or certificate of authorization indicating that this person or domestic company is fully authorized and unique person/company for issuing proposals and signing contract for "supply of DCS for PETKİM ACN Plant Project" on behalf of subject foreign company is to be presented to PETKİM with application.
 
Such authorization letter/certificate shall be approved by relevant country's Chamber of Commerce/Industry and then the signature and stamp of subject chamber of commerce on authorization letter/certificate shall also be approved (witnessed) by Turkish Consulate or Embassy.
 
•  The Bidders shall submit the originally signed or sealed copies of the required eligibility documents.
 
•  One copy of PETKİM Tender Document is to be signed or sealed by BIDDER and submitted to PETKİM together with the BIDS.

QUALIFICATION CRITERIA FOR FIRMS

1. Legal correspondence address
2. Copies of original documents defining the legal status, place of registration and official address of management
3. A certificate from the Chamber of Commerce or Industry where the company is registered and currently in operation
4. Proof of authorization in the form of written power attorney
5. Reports on the financial standing such as profit and loss statements and auditors reports for past five years, and an authority to seek references from Company bankers
6. Location of procurement center(s) where purchasing activities shall be carried out.
7. Be experienced in procurement of equipment and materials for the last 5 years to be certified by presentation of equipment final acceptance certificate.
8. Give references show that the company have designed fender system not less than the value of contract and finished procurement of materials.
9. Have paid the provisional bond of the project.
10. Have Signature specimen certificate and declaration for make a bid.
11. Documents of qualification criteria shall be signed or delivered as the copies with official indorsement .
12. Give documents show that the company have unused cash at least 70% of the value of contract and letter of guarantee credit from the banks that the company worked with.
13. A licensee from the foreign firm showing that Turkish agent has authorization to join the bid.
14. Submit officially audited balance sheet for at least 3 years.
15. Turkish agent not has been banned from government bids according to Government bids law No: 2886 and 4734 of Republic of Turkey .
16. Turkish agent has fully paid income taxes for past five years (starting from the year of foundation for companies founded after 1999). Documents shall be submitted showing the income corporate Income and Corporate Income taxes declared on tax forms for years 1999-2005 and statement of the addressed Tax Department releasing the company from unpaid taxes, copy of Tax Statement Form filed for 2003 and document showing that the first installment has been paid.
17. Documents of qualification criteria and technical documents shall be delivered in a differenet envelope(outer envelope). Commercial proposal shall be delivered in the other envelope(inner envelope). Names of envelopes shall be noted on it.Commercial proposals submitted by insufficient technical documents shall be rejected without evaluation.
18. Petkim has rights to invite the half of the bidders to price reduction in case of at least three appropriate bidders both technically and commercially.
19. Petkim is free in making the tender or not.

  Complete engineering, equipment and materials, supervision and training services will be supplied for Liquid Nitrogen Storage Tank at Air-Nitrogen-Oxygen Production Plant in Aliağa Petkim Complex. The properties of Liquid Nitrogen Storage tank are given below.

  • Type: Vertical type, cryogenic double tank (inner and outer side)

The Bidders shall furnish, as part of bid, documents establishing Bidder's Eligibility Qualifications stated below. These Documents should be included in the same envelope containing the technical proposal of the bidders. The bids of the bidders detected as falling to fulfill qualification criteria shall not be assessed.

QUALIFICATION CRITERIA FOR BIDDERS

  5. Reference List of experienced in detail engineering, procurement of equipment and materials and supervision services for the last 5 years to be certified by presentation of equipment final acceptance certificate.
  6. “EQUIPMENT ACCEPTANCE CERTIFICATE” indicating that the Equipment, Instruments and material supplied by BIDDER within past five years, successively provided the desired current efficiency under the conditions stated in the Technical Specification, at least two years.
  7. All documents requested in Qualification Criteria shall be submitted as official approved and signed.
  8. In case the Turkish Bidder representing for another Foreign Company submits tender, a statement of authorization and letter of signature circular indicating that he is authorized to bid on behalf of that company shall be presented together with the bid. Otherwise, the domestic bidder shall not claim any right based on the fact that tender documents has not been presented to him.

Domestic bidders shall also present the following documents:

•  An official statement indicating that they have not been banned from government bids according to Government Bids Law No: 2886 and 4734 of Republic of Turkey .

•  A statement showing that they have fully paid income taxes for the past five years (starting from the year of Foundation for companies founded after 1999).

4.1.12 The Bidder’s Technical Personnel Declaration pertaining to the organizational structure and in order to accomplish the Works, the number and qualifications of the technical personel allocated are in compliance with the ones envisaged in the Administrative Specification.
 
4.1.13 A legal document indicating that the Tender Document has been purchased by the Bidder.
 
4.1.14 The Tender Document each page of which signed and stamped by the Bidder.In case of joint venture, it is mandatory that each partner of juridical or real persons to submit the documents required in (4.1.1), (4.1.2), (4.1.3), (4.1.4) and (4.1.6) separately.
 
4.2. ELIGIBILITY CRITERIA
 
4.2.1 Work Experience Certificate showing the experience of the Bidder pertaining to the work which is subject of the bid or similar work within the last fifteen (15) years, in either the public or the private sector, either in the country or abroad and which was deemed by the Owner as being completed without fault.
 
As for the content of Work Experience Certificate; costs of the main work groups such as engineering, construction, mechanical, electrical and instrumentation including detailed scope list, and photographs related with jobs conducted, if any, shall be presented by the Bidder.
 
In this tender, the term “similar work” to be evaluated in the eligibility criteria concerning the work experience shall be considered as the work including design, engineering, supply and manufacturing and construction of the spherical tanks showing similar characteristics in view of size and quality thanks to same or similar construction-erection procedures and techniques.
 
The documents proving work experience are the “Work Completion Certificate” which shows the experience of the bidder in the work that is the subject of the bid or the similar works, “Sub-contractor’s Work Completion of Certificate”, and “Work Status Certificate”.
 
In case joint venture, it will be sufficient that any partner provide work experience specified.
 
4.2.2 It is required that the Bidder should certify that he has any of the certificates of ASME U2 or ASME U.
 
4.2.3 The documents establishing eligibility to be submitted by the Bidders shall be assessed according to the criteria noticed and the bidding envelopes of the Bidders regarded as eligible shall be opened and evaluated by tender commission. The Letters of Bid of the Bidders regarded as ineligible due to submission of missing or unacceptable documents not responsive to the eligibility criteria specified will be returned unopened to the Bidders. After opening of the bids, by no means, those Bidders that are detected to submit missing or unacceptable eligibility documents will not be asked to complete the missing information or to submit else documents.
 
4.3 The documents specified above in 4.1 and 4.2. should include the followings:
 
4.3.1 The Bidders shall submit the original or notary approved copies of the document specified above. It is mandatory for the notary approved documents affixed by a cachet of “Aslına Uygundur”. The copies of the documents approved without seeing the original ones and the documents affixed by a cachet of “İbraz Edilenin Aynıdır” or similar statements shall not be accepted.
 
4.3.2 The Bidders, may add to their bid the approved copies affixed by a cachet of “Aslı İdarece Görülmüştür” or similar statements instead of the original documents.
 
4.3.3. The original documents which are obtained from abroad by the Bidders or theirs Turkish translations shall be arranged in accordance with the subjects specified in the relevant articles of the Administrative Specification.
 
5- The Tender is available to all domestic and foreign Bidders that bear the participation conditions.
 
6- The Bidders can not submit bids for the tender by creating a consortium.
 
7- Tender Documents may be examined at the address given below and received upon payment of a non-refundable fee of YTL 800.- from the same address.

9- Bid Bond at the rate of minimum 3 % of the bid price shall be submitted by the Bidders. Bid Bonds shall be in conformity with the provisions specified in the Administrative Specification and sample form given in its Annex provided that it has a time limit covering a period not less than 30 (thirty) days following to the date of the tender.
 
10- The validity of the bids should be minimum 90 (ninety) calendar days from date the date of opening Tender.
 
11- Since our company is not subject to the provisions of Public Tender Law No.4734, the Administration is free in making the tender partially or completely or not to realize, or to award the Contract to any bidder.
